Why There's a Need for a Certificate of Disposition

For the uninitiated, a certificate of disposition is a New York document that states a criminal cases' current status. This document serves as proof that a case is over and has already concluded a definite disposition. Where you get your certificate depends on where the crime took place. Be it in Richmond County, Queens County, Bronx County, Kings County, or New York County, expect the process of acquiring this document to be the same.

 

What does a Certificate of Disposition contain?

What applicants should remember is that each case needs a separate Certificate of Disposition. So if you've been arrested more than once, each incident would require one piece of document. The document will have in it the criminal sentence imposed, the date of your conviction if proven guilty, your offenses for your conviction, what you were charged with or what you were arrested for.

 

A Certificate of Disposition costs $10 per application.

 

Who needs a Certificate of Disposition?

Essentially, those who have been arrested before and want proof that the case is over will need a Certificate of Disposition. Individuals unfortunate enough to have more than one case need this piece of document all the more, to prove that those cases are already closed.

 

A Certificate of Disposition usually requested if a person is looking to apply for a job, get a new place or rent an apartment, apply or renew a license, apply for a US citizenship, or if charge again with another act of felony.

 

Sealed Criminal Records

The state of New York currently has no laws that totally delete criminal records, but they are "sealed" if a case obtained a good result or if it was a crime committed by youthful offenders or children. If your case happens to be sealed, you have to provide a notarized statement along with an I.D. with your picture and address in it before the court grants of the certificate.
